INFORMATION REGARDING THE HANDLING OF PERSONAL DATA

In accordance with Article 13 of the law regulating the protection of personal data (Italian Legislative Decree 196/03), we inform users of the following:

OWNERSHIP AND RESPONSIBILITIES REGARDING THE HANDLING OF PERSONAL DATA

Arkavita s.r.l., with its registered offices in Via Alfieri, 6 – 10121 Turin (Italy) is responsible for the processing of data.

DATA HANDLING LOCATION

All data are processed at the company’s registered offices and by its suppliers of IT services.

All data are processed by trained and specifically authorized personnel, including website maintenance operators.

Particularly the data held in electronic format connected to online services and collected through our website are held in computer systems managed by third-party suppliers of technical services.

Our online store is hosted on Shopify Inc. Shopify supplies us with the online e-commerce platform which enables us to sell our products and services. All data are saved on Shopify’s databases on a safe server protected by Firewall.

VOLUNTARY PROVISION OF DATA

Users are free to supply any personal data necessary to the fulfillment of their requests. Failure to provide data may mean that it will be impossible to meet the specific request.

TYPES OF DATA HANDLED AND MEANS AND PURPOSE OF HANDLING

When users visit and consult our website, the personal data handled are limited to browsing data, which are those data that must be transmitted to the website in order for the information systems to work in managing the website and Internet’s communications protocols. Browsing data are, for example, IP addresses, or domain names of computers used by users connecting to our website, or other parameters referring to the operating system used by users.

When users register on our website or while dealing with orders, Arkavita also collects personal data voluntarily given by users, such as name, surname, date of birth, tax code, address, telephone number, email address, and other optional information such as credit card details.

Browsing data

During the normal process, computer systems and software procedures that operate our website acquire some personal data the transmission of which is implicit in the use of Internet communications protocols.

This information is not collected in order to be associated with identified interested parties, but due to its very nature it could be processed and associated with data held by third parties, thus allowing users to be identified. Such data, however, are not collected in order to associate them with identified users and are cancelled immediately once anonymous processing has been completed. Arkavita respects the prescribed terms and removes all user browsing data particularly once their use is no longer necessary.

This category of data includes IP addresses, domain names of computers used by users who connect to our website, URI addresses (Uniform Resource Identifier) of requested resources, the time of the request, the method utilized to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server (successful, error, etc.) and other parameters related to the operating system and the users.

Cookies

A “cookie” is a text file that can be placed in a space on the hard disk of users’ devices, e.g. computer, tablet, smartphone, etc. when users visit our website via their own browser. The cookie enables the device containing it to be identified for the entire period of validity or registration of the cookie.

Our website does not make use of third-party cookies or of user profiling.

While visiting our website any information relevant to browsing data received by the user device may be stored in “cookies” installed on the device itself. When users make their first visit, they will be informed of the use of cookies in a message contained in a banner. Continuing to browse once the banner has been visualized means that users agree to the use of cookies.

However, it is possible to modify the cookie settings at any time. More information concerning cookies and how to handle settings is given below.

This website can send and then receive “cookies” or similar files from the users’ Internet browsers.

When users browse on our website, Arkavita monitors and uses cookies in order to:

¬ compile statistics, monitor the volume of traffic and calculate how much each section of the website is used (e.g. titles and contents visited, the flow of clicks), with the aim of improving the efficiency and the accessibility of online services;

¬ calculate the total number of advertisements, identify them and the number of times shown, identify the number of users who click on each of them, and, whenever possible, the subsequent actions taken by the users on these pages in order to calculate the amount owed to commercial partners (e.g. communications and advertising agencies, websites, etc.), for aggregated statistical analyses;

¬ customize the website presentation to the viewing settings of devices (language, display resolution, operating system, etc.) while users are visiting the website, according to the hardware, the software and the video software of the devices themselves;

¬ customize advertising spaces to the viewing settings of the users’ devices (language, display resolution, operating system, etc.), according to the hardware, the software and the video software of the devices themselves;

¬ if users have given personal data, including contact details, and have chosen to accept the cookies when signing up or accessing services, the browsing data acquired through the cookies may be linked to the users’ personal data with the aim of forwarding advertising material or of visualizing customized advertisements on users’ devices in the advertising spaces that use our cookies. These are advertisements specifically aimed at the users and which may interest users personally;

¬ store any information contained in forms completed on the website and any information relevant to certain products or services selected through the website (e.g. services for which the user has signed up or are contained in the shopping basket, etc.);

¬ allow access to reserved and customized areas, e.g. accounts, based on usernames, passwords and other data previously supplied by users;

¬ implement security measures (e.g. enabling registered users to be recognized during subsequent visits after a period of time, by requesting them to log in again);

¬ acquire data anonymously for statistical purposes regarding the percentage of emails delivered compared to emails sent, of emails read, messages opened, forwarded to third parties, the number of clicks, etc.;

¬ count the single visitors to a web page or to a service;

¬ process aggregate statistics regarding how our website and the services it contains function;

¬ improve the performance of our website by making searches faster for users;

¬ collect data relevant to user traffic and the interaction on the website in order to identify trends and assess our audience;

¬ store information concerning user preferences and thus customize the website based on the users’ specific interests;

¬ avoid the same advertisements being shown several times;

¬ recognize users’ computers when they reconnect to Arkavita’s website;

¬ memorize the products previously selected and placed in the shopping basket;

¬ assess the degree of appreciation, again anonymously, of the services available on the website, including the advertisements;

¬ improve users’ experience of browsing by suggesting the best products and offers according to previous visits;

¬ identify and acquire information on personal preferences, with the consent of the user who can cancel it at any time, of users registered in the reserved [UdMO1] ;

¬ proceed to the sale of products and payment for goods ordered.

When users access the Home Page or other pages of our website, they view the banner containing a brief informative note regarding cookies present, and they have access to this Privacy Policy including the information specifically relevant to cookies; by continuing to browse on our website, users give their consent to the use of cookies.

Users may also express or modify their choices regarding cookies at any time, as described below.

It is possible to configure the browser to allow cookies to be stored on a device, to refuse them automatically or to refuse some of them. It is also possible to configure the browser in order to view the request for acceptance or refusal of cookies before they are installed.

Refusing cookies

Should users choose to disable the installation of cookies on their devices, or should any cookies already installed be removed, it will not be possible to use the functions necessary for browsing some sections of our website. For example, this applies to some contents or services for which it is necessary to log in in order to access them. Moreover, in relation to technical compatibility, it may be impossible to recognize the type of browser in use on users’ devices, the default language or the country from which the terminal is connected.

Should devices show contents developed with Flash technology, users must access the Flash cookie handling tool of the relevant provider.

Voluntary data provided by users

Arkavita collects and processes personal data that users provide voluntarily when they interact with our website and request access to the options and services offered on our website.

If users’ explicitly and voluntarily send personal data on this website, Arkavita subsequently acquires them in order to meet users’ requests.

Any personal data will be handled for commercial purposes, direct sales, marketing and commercial information, promotional and statistical purposes, and to monitor consumer preferences. Under no circumstances are such data used for purposes of profiling.

The provision of data such as surname, name and email address is necessary in order to enable users to register on our website and access the section reserved for users. It also enables users to receive assistance during purchases, e.g. the service aimed at verifying / overcoming any possible technical difficulties encountered by users.

The provision of personal data will also allow users to receive promotional email messages. Users’ consent is necessary for the handling of such data.

The provision of personal data (name, surname and email address) is also required in order to consent to the completion of contractual obligations in the event of users placing a purchase order and in order to guarantee post-sales assistance.

Other personal data (e.g. telephone or mobile phone numbers, etc.) are not compulsory. If users provide them, they will be used to contact users for communications regarding their orders, or to verify customer satisfaction with the product received.

Credit cards

By giving consent to the handling of the relevant data, users authorize Arkavita to save credit card details, only in order to avoid having to provide them again during future payments. Credit card details will be forwarded to third parties in order to complete payment. In the “Account” section, users can modify, register or delete data relevant to their credit cards.

The provision of credit card details is not compulsory, but if withheld, it will not be possible to complete payments with this means.

Furthermore, should users fail to provide such data when registering, the credit card details will not be registered.

Third party data

In the area of our website dedicated to the purchase of products, users have the possibility of sending goods bought to third parties. In this case, users will be required to provide the details and postal address of the recipient to whom the products are to be sent.

These data are used solely – and for no other purpose than – to ship goods ordered by users. They will be cancelled once the order has been processed.

Users must ensure that the communication of the personal data of third parties and the subsequent use of such data on the part of Arkavita conform to the Privacy Policy and to the regulations in relation to the intended purposes on a case-by-case basis. For example, users may provide third party data only after informing the same and obtaining their consent, if required by the Privacy Policy.

HANDLING OF DATA

All data are used in accordance with users’ choices, freely exercised by giving their informed consent at the time of or subsequent to the collection of the data.

The data are held only for the time necessary to effect such processing operations required by the provision of user data, in accordance with their choices, preferences and indications.

The data are stored both electronically and on paper, also making use of automatized devices. The security measures provided for under the current legislation are implemented in order to prevent the loss of data, the illegal or illicit use of data, and any unauthorized access to data. Moreover, the computer systems and programs are configured in such a manner as to reduce to a minimum the use of personal or identification data, which are used only when required for specific handling purposes on a case-by-case basis. For example, all personal data are registered and stored on safe servers, access to which is controlled and permitted only to duly authorized personnel.

User data can be used, unless users expressly withdraw consent, by distance communications technology which allows individual communications to be sent for advertising purposes, for direct sales, market research or commercial communications.

Finally, all data may be forwarded to public authorities upon presentation of a legal order produced by the same and, if necessary, may be used to investigate any responsibility in the event of possible computer crimes towards the website.

Some handling of personal data may be effected by third parties, based in Italy and/or abroad. Said third parties may be entrusted with certain activities (or parts of activities) of a technical, organizational or processing nature, or functional to or connected with the fulfillment of contractual obligations, e.g. delivery companies, payment services, accountancy agencies.

In such cases, these parties will operate as the autonomous owners or will be designated as being responsible for or in charge of data handling. The designated parties responsible or in charge will receive suitable operational instructions, with particular reference to the adoption of minimum security measures, in order to guarantee privacy and data security.

All parties placed in charge receive specific indications relating to data handling, instructions that they are bound to respect in order to avoid disciplinary sanctions and / or legal action.

THE RIGHTS OF THE INTERESTED PARTIES

The interested parties have the right to exercise the rights provided for in Article 7 of Italian Legislative Decree 196/200 and more specifically, the interested parties have the right to obtain confirmation concerning whether personal data regarding them exist or not, even if they are not yet registered, and they may request that such data be communicated in an intelligible form.

The interested parties have the right to obtain information concerning:

a) the origin of personal data;

b) the purposes and means of data handling;

c) the logic applied in the event of handling using electronic tools;

d) the identification of the holder, those responsible for handling, and where applicable, the designated representative on the territory of the Italian State;

e) the parties or categories of parties to whom any personal data may be communicated or who may be aware of any personal data in the role of designated representative on the territory of the Italian State, or responsible for or in charge of handling.

The interested parties have the right to obtain:

a) the update, rectification or, when interested, the integration of data;

b) the deletion, the transformation into an anonymous form or a block on any data processed in contravention of the law, including data the storage of which is not necessary in relation with the purposes for which they were collected or subsequently processed;

c) certification that the operations contained above in letters a) and b) have been made known, also regarding their content, to those who have received communication of the data, unless compliance proves impossible or might lead to the use of means that are clearly disproportionate to the right protected.

The interested parties have the right to oppose in whole or in part:

a) the processing of personal data regarding them, although pertinent to the purpose of collection, if there are legitimate reasons;

b) the processing of personal data regarding them with the purpose of forwarding advertising material or effecting direct sales or market research or commercial communications;

All rights mentioned above may be exercised personally or by proxy, if confirmed in writing, by a person or persons or associations.
